This application has been recommended for approval for the following reason.

The development is not detrimental to the character and appearance of the host dwelling; and it preserves the character and appearance of the Woodbourne Road Conservation Area. It therefore complies with the Development Plan and relevant legislation.

## Officer’s Report

### 1.0 THE SITE

1.1 The application relates to a two-storey terraced house on the east side of Mount Bradda, within the Woodbourne Road Conservation Area.

### 2.0 THE PROPOSAL

2.1 Retrospective planning permission is sought for the replacement of the front door. The new door is black with two vertical glazed panels at the top and two solid panels at the bottom. It has a metal letterbox and door handle. There is an arched glazed panel above the door.

### 3.0 PLANNING POLICY Site Specific

3.1 The application site is within the Woodbourne Road Conservation Area, designated for its special character. There are no Registered Buildings, Registered Trees or Registered Tree Areas that would be affected by the proposal; and the site is not at risk of flooding. Area Plan for the East 2020

3.2 The site is within a predominantly residential area. Isle of Man Strategic Plan 2016

3.3 Strategic Policies 3(b) and 5 concern the protection of local character and the environment.

3.4 Strategic Policy 4(a) requires development to protect or enhance the fabric and setting of Conservation Areas; and Environment Policy 35 requires development to preserve or enhance their character or appearance and to ensure that the special features contributing to their character and quality are protected.

3.5 General Policy 2 provides that development in accordance with land use zoning and other relevant proposals and policies of the Development Plan will normally be permitted subject to certain criteria, including those below which are relevant to this proposal. The development should:

- (b) respect the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) not affect adversely the character of the surrounding landscape or townscape; and (g) not affect adversely the amenity of local residents or the character of the locality.

### 4.0 OTHER MATERIAL CONSIDERATIONS Legislation

4.1 Section 18(4) of the Town and Country Planning Act (1999) states, "(4) Where any area is for the time being a conservation area, special attention shall be paid to the desirability of preserving or enhancing its character or appearance in the exercise, with respect to any buildings or other land in the area, of any powers under this Act". Other

### 5.0 PLANNING HISTORY

5.1 97/01803/B: Installation of replacement windows. Permitted.

### 6.0 REPRESENTATIONS

6.1 Douglas City Council - no objection (23/12/25).

6.2 Highways Services, DoI, was consulted on 11/2/26 and has not made comments at the time of drafting this report.

### 7.0 ASSESSMENT

7.1 The main issue is the effect of the proposed development upon the character and appearance of the host dwelling and the Woodbourne Road Conservation Area.

7.2 The Woodbourne Road Conservation Area Appraisal notes that Upper Douglas is characterised by small and distinctive neighbourhoods, including carefully designed terraces with distinctive architectural detailing and rhythm. Mount Bradda is one such terrace, with the house frontages having several common features including bay windows, small dormers, arched first floor windows and arched glazing and mouldings above the front doors.

7.3 The panelled design of the door installed at the application site reflects that of the majority along the terrace, although they differ from house to house in respect of colour, glazing style and door furniture. Whilst there is no longer any moulding along the top of the door itself and the door is not recessed as some still are, the moulded arch above above the door remains, as does the arched glazing panel. The submitted photographs show that the moulding along the top of the door and the recess have been missing for some time, and other properties in the terrace have also lost these features. Moreover, the door now present has a more traditional appearance than the one it has replaced.

7.4 Overall, while the doorway is not now as it was originally, the retention of a traditional design and the arched features above the door are sufficient to maintain the distinctive appearance of the property and the terrace as a whole. Thus there is no detriment to the character and appearance of the host dwelling and the character and appearance of the Woodbourne Road Conservation Area is preserved.

7.5 Consequently, the development complies with Strategic Policies 3(b), 4a and 5, Environment Policy 35 and General Policy 2 of the Strategic Plan; and with Section 18(4) of the Town and Country Planning Act 1999. Other Considerations

7.6 Given the nature of the development, there are no concerns in relation to neighbouring living conditions or highway safety. No other issues have been raised.

7.7 As the door is already in situ and of an acceptable design, no conditions are necessary.

### 8.0 CONCLUSION

8.1 For the reasons given above, the development is not detrimental to the charatcer and appearance of the host dwelling; and it preserves the character and appearance of the Woodbourne Road Conservation Area. Thus it complies with the Development Plan and relevant legislation and is recommended for approval accordingly.

### 9.0 RIGHT TO APPEAL AND RIGHT TO GIVE EVIDENCE

9.1 The Town and Country Planning (Development Procedure) Order 2019 sets out the process for determining planning applications (including appeals). It sets out a Right to Appeal

- (i.e. to submit an appeal against a planning decision) and a Right to Give Evidence at Appeals (i.e. to participate in an appeal if one is submitted).

9.2 Article A10 sets out that the right to appeal is available to:

- applicant (in all cases);
- a Local Authority; Government Department; Manx Utilities; and Manx National Heritage that submit a relevant objection; and
- any other person who has made an objection that meets specified criteria.

9.3 Article 8(2)(a) requires that in determining an application, the Department must decide who has a right to appeal, in accordance with the criteria set out in article A10.

9.4 The Order automatically affords the Right to Give Evidence to the following (no determination is required):

- any appellant or potential appellant (which includes the applicant);
- the Department of Environment, Food and Agriculture, the Department of Infrastructure and the local authority for the area;
- any other person who has submitted written representations (this can include other Government Departments and Local Authorities); and
- in the case of a petition, a single representative.

I can confirm that this decision has been made by the Head of Development Management in accordance with the authority afforded to that Officer by the appropriate DEFA Delegation and that in making this decision the Officer has agreed the recommendation in relation to who should be afforded interested person status, and/or rights to appeal.
