## Town and Country Planning Act 1999

### The Town and Country Planning (Development Procedure) Order 2005

In pursuance of powers granted under the above Act and Order, the Department of Infrastructure determined to **REFUSE** planning application by Mr Lee Dixon, ref **13/00417/B**, for the erection of a dwelling at Plot to rear of 47 Governors Road Onchan Isle of Man for the following **reason**:

1. The proposed dwellinghouse would be contrary to General Policy 2 and Environment Policy 42 of the Isle of Man Strategic Plan 2007 by reason of its design and siting and would:

i) result in the introduction of a dwellinghouse which is out of keeping with the general character and appearance of the locality by reason of the proposed siting, layout, scale, form, design and landscaping of buildings and spaces around and would therefore cause significant harm to the visual amenities of the street scene;

ii) result in demonstrable harm to the occupiers of No. 37 and 47 Governors Road by reason of loss of privacy and overlooking; and iii) result in an increase in demand for parking resulting in increased levels of congestion in an already congested area. Date of Issue: 9th July 2013
