ISLE OF MAN PLANNING SCHEME (DEVELOPMENT PLAN)
PROVISIONAL ORDER 1982

To: Mr. KINLEY,
Bourne House,
Bourne Place,
RAMSEY.

In pursuance of their powers under the above Acts and Order the PLANNING COMMITTEE of the Isle of Man Local Government Board do hereby PERMIT development in accordance with the application made by and the plans submitted by on behalf of

BALLAMANHEEN L. 1982 1982 1983 1984 1985

hereinafter called "the applicant" and approved by the Planning Committee on 24th day of February, 1984, subject to compliance with the conditions or modifications specified hereunder:-

(1) The building(s) shall not be used for any other purpose than that indicated on the plan or in the application without the consent of the Committee.
(2) The development shall be completed within the period of TWELVE (12) months from the date of this approval WHICH SHALL CEASE TO HAVE EFFECT IN DEFAULT OF COMPLIANCE WITH THIS CONDITION except in respect of any development completed within that period.
(3) Subject to the last foregoing condition the development having been commenced shall be carried on to completion in a workmanlike and expeditious manner to the satisfaction of the Planning Committee and if not so completed within the said period of TWELVE months it shall be a further condition of this approval that the applicant shall submit a new application for consideration by the Committee in respect of the uncompleted development.

(4) All services including electricity and telephone must be laid underground to the satisfaction of the Committee and arrangements for the supply of such services acceptable to the Committee must be made PRIOR to the commencement of any building works.

(5) The roof must be slate or a slate-like material to the satisfaction of the Committee.

(6) Landscaping and the planting of young trees and shrubs must be carried out according to a scheme which must be submitted to and approved by the Board of the Board of the Committee to the commencement of any building works.

(7) The proposed dwelling must be retained as part of the agricultural holding known as "Ballamanaugh" as defined in the submitted plan and must not be sold or let off separately therefrom, to the satisfaction of the Planning Committee.

(8) The occupation of the proposed dwelling must be limited to persons whose employment or latest employment is or was employment in agriculture in the Island and including also the dependants of such persons as aforesaid and such tenancy must be subject at all times to enquiry and approval by the Committee.

(9) The size, design and position of the septic tank and its soaks may shall be to the satisfaction of the Byelaw Officer.

Except as aforesaid, this permission is granted subject to due compliance with the Building Byelawr, Local Acts and Regulations and general statutory provisions in force in the area, and nothing herein shall be regarded as dispensing with such compliance except to the extent herein specified.

PROVISIONAL ORDER 1962

Effect of initial decisions

10. (1) An initial decision shall not have effect until the time for applying for a review of the decision has expired and, if such an application is duly made, until the review thereof, 56d and subsequent appeal in respect hereof, has been finally discussed or until the relevant times for appeal have expired or the appeal has been duly withdrawn.

In pursuance of their powers under the above Acts, and Byelaws, the PLANNING COMMITTEE of the Isle of Man Local Government Board, being the Byelaw Authority, at a meeting held on the 24th day of February, 1984, APPROVED the plans submitted by you on behalf of

BALLAMANAHER LTD - Direction of dwelling, Field 1774, Ballamannagh, Gulby, LEMAYNE.

The passing of these plans operates as an approval thereof only for the purposes of the requirements of The Building Byelaws 1976.

It is an offence to fail to give notice of commencement and completion of certain stages of work and the enclosed extracts of Byelaws A12 and A16 should be forwarded to the person undertaking the work for which approval has been given.
