with the ecological assessment and method statement for translocating the grassland; drawings llC, s102/AO, IOM39-P002, -POlO, -POll, -POI2, -POl3, POI4-1, -POI4-2, -POlS, -POI6, -POll, -POI8, -POI9, -P020, -P021, -P022, -P023, -P024, -P02S, -P026, -P021, -P028, -P029, -P030, -P031, -P032, -P033, -P034 P03S and the location plan all received on llth October, 2004.

the adopted highway up to the access to the dwelling, to the satisfaction of the Planning Authority after consultation with the Highway Authority.

4. No dwelling may be occupied until the parking facilities and vehicular access(es)

#### have been completed to the satisfaction of the Planning Authority after

consultation with the Highway before being brought into use and such facilities must be thereafter so retained.

#### S. No works may commence upon the construction of the penultimate dwelling on

the site until such times as the estate road has been completed to the satisfaction of the Planning Authority after consultation with the Highway Authority.

- 6. All planting, seeding or turfing comprised in the approved details of landscaping must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.
- 7. Prior to the erection of any dwelling, the applicant must have approved by the Planning Authority a sample panel of all finishes together with details of the colours of render to be applied to each property. The Committee would encourage the introduction of some variety in the colour or type of finish in the various components of the terraced properties, particularly in respect of the dwellings on plots 14, 15 and 16. The Committee would also encourage the use of finish materials which employ a self-coloured finish to ensure that the colours chosen and agreed are retained in the future.
- 8. Prior to the occupation of the penultimate dwelling, the works proposed for the presentation and enclosure of the mound must be completed to the satisfaction of the Planning Authority.
- 9. The Manx Museum and National Trust must be informed of the date when building work. is to commence and be given aCCESSat all reasonable times, and reasonable opportunity to inspect the site, observe all excavations and investigate any archaeological features exposed.

NOTE The Department of Transport recommends that on completion the proposed development will become a Home Zone and the features of such Zones at the access points must be constructed to the satisfaction of the Highway Authority.

NOTE An agreement under Section 4 of the Highways Act 1986 must be entered into between the development and the Department of Transport prior to any works commencing on site. The developer should make contact with the Network Planning Section (teiephone 686682). Failure to enter into such an agreement before works commence will result in the roads not being adopted and such information will be disclosed on legal searches in respect of the site.

NOTE The applicant is advised to consult the Fire Service with regard to access for Fire Appliances and the location of Fire Hydrants, and the requirements of the Fire Precautions (Flats) Regulations 1996.

NOTE For connections to Flats and Apartments the following apply - "Water Supply to

and Apartments - Regulations", and if applicable a "Form Of Undertaking In Respect Of Supply Pipes" will be required. Copies of these documents can be obtained from the IoMWA or by contacting the IoMWA Byelaws Inspector (Les Quayle on telephone 695957).

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule I of the Isle of Man Planning Scheme (Development Plan) Order 1982.
