In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the application made by you

Incorporation of lane into gardens of adjacent dwellings

which was considered on 30 January 2004, for the reasons set out in the attached schedule.

## Reasons For Refusal

**Application Ref No:** 03/01165/B On Review

1. The development precludes pedestrian access to the rear of Numbers 5-10 Close Rushen, Farrants Park. It is considered that this loss of access which would necessitate the removal of waste and refuse from the rear through the dwellings would be detrimental to the residential amenity of occupiers of those dwellings.

**NOTE:** Within one month of the date of this decision the walls must be removed and the lane reinstated.

**NOTE:** This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.
