**THE APPLICATION SITE AND PLANNING APPLICATION** The application site comprises the curtilage of Andreas Church Hall in Andreas Village. The planning application seeks approval for the use of the hall for day car purposes. **PLANNING HISTORY**

The application site has not been the subject of any previous planning applications that are specifically material to the assessment of this current planning application.

**REPRESENTATIONS** Andreas Parish Commissioners have no objections to the planning application. The Department of Transport Highways Division do not oppose the planning application.

The owner and/or occupant of Andreas Rectory, which neighbours the application site, object to the planning application. The grounds for their objection can be summarised as concern that an increase level of use will result in increased parking and potential obstruction of their access. They suggest that the church hall's car park is unlikely to be used and parking will therefore occur on the double yellow lines outside the hall.

## **PLANNING POLICY**

In terms of land use planning, the application site is located within a wider area of land that is designated as being of predominantly residential use under the 1982 Development Plan Order.

In terms of strategic plan policy, although the Isle of Man Strategic Plan contains policies identifying general planning considerations that are applicable to the assessment of a planning application it is considered that there are no specific policies within the plan that are material to the assessment of this current planning application.

**ASSESSMENT**

The planning application seeks approval for the use of the hall for day care purposes. The application, which includes an explanation of the proposed use, states:

- that the Ayre Playgroup has been in existence for fourteen years;
- that approval is sought to use Andreas Church Hall due to difficulties with their current venue;

- that the church hall would be used two to three times a week for the day care of approximately fifteen children, with two carers looking after the children;
- that it is their intention to use the current car park for parent access; and
- that they currently operate on Monday morning and Friday morning during terms times and also on a Wednesday morning from February to July as an extra day for children preparing to go to school after the summer holidays.

The application includes a basic transport survey and the applicant highlights that the hall is already used for Sunday School and other Church activities.

In terms of the appropriateness of the application site for the proposed use it is felt that a children's day care facility is a use that can be commonly found operating within church halls. As such the proposed use is considered to be compatible with the church hall. In terms of impact on the amenity it is considered that the indicated level of use is unlikely to cause detrimental harm to the surrounding area and the level of traffic generated by the proposed use is likely to be low. The application site has on-site car parking provision, which should be able to accommodate parking generated by the proposed use.

Parking on the area indicated as problematic by the owner and/or occupant of Andreas Rectory is prohibited by double yellow lines. Given that planning has to assume that such designations will be respected, the level of use and that the application site has on-site car parking provision it is concluded that these concerns are not sufficient to warrant refusal of the planning application.

It is recommended that the planning application be approved.

It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:

Andreas Parish Commissioners; The Department of Transport Highways Division; and The owner and/or occupant of Andreas Rectory.
