In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

which was considered on 24th April 2008, for the reasons set out below.

### Reason(S) For Refusal:

1. The proposed sculpture would be contrary to General Policy 2 of the Isle of Man Strategic Plan 2007 by reason of its size and siting and would introduce a prominent and incongruous structure which is out of scale with the surrounding buildings and will be detrimental to the visual amenities of the locality.

**Note:** The Planning Committee expressed concerns relating to Health and Safety issues that the proposed sculpture would introduce, specifically as a result of its height.

**Note:** Any future application should be accompanied by a written representation from the Department of Education.

**Note:** This refusal is without prejudice to a future planning application which proposes a sculpture of a scale which overcomes the reason for refusal, specifically the height of the proposed sculpture.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

- Any appeal has been determined;

Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
