### Peason(S) For Refusal:

1. The proposed material change of use of the application site from agricultural use to a campsite for motor homes would represent an inappropriate use of the land that would be incongruous and visually damaging to the surrounding area recognised as being of High Landscape Value. As such the proposal would be in conflict with Strategic Policy 2, General Policy 3, Environmental Policy 1 and Environmental Policy 2 of the adopted Isle of Man Strategic Plan 2007.

Note
Within a period of 28 days from the date of this decision becoming final, the applicant must:
i) cease the use of the site for the parking of motor homes and vehicles used for residential purposes (whether permanent or tourist use) and remove such vehicles from the site; and
ii) restore the site to an agricultural field with all hard surfacing associated with the parking of motor homes removed.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

I refer to the above application which was refused by the Planning Committee at its meeting held on the 16 May 2008. The refusal notice is enclosed, and an appeal against the decision may be lodged within 21 days of the date of the notice.

The Committee has determined that, within 28 days of the date that this decision becomes final:
i) the use of the site for the parking of motor homes and vehicles used for residential purposes (whether permanent or tourist use) must cease and any such vehicles on the site must be removed; and
ii) the site must be restored to an agricultural field with all hard surfacing associated with the parking of motor homes being removed.

The decision becomes final if an appeal is not lodged within the specified time, or on the determination of an appeal.

Failure to comply with this direction may result in the matter being referred to the Minister of the Department of Local Government and the Environment with the recommendation that legal proceedings be instigated for breach of planning control.

Your attention is drawn to Section 23 (2) of the Town and Country Planning Act 1999 which states that:-
"(2) Any person who commences or carries out any development in breach of planning control is guilty of an offence and liable on summary conviction to a fine not exceeding £5,000."
