### Reason(S) For Refusal:

1. By reason that there is insufficient agricultural need for the proposed hard-standing the proposal represents the development of land not designated for such purpose. As such the proposal is contrary to the presumption against the development of land set out by Policy L/OSNC/PR/ of the Laxey and Lonan Area Plan Order 2005 and General Policy 3 of the Isle of Man Strategic Plan 2007.
2. The proposed development will result in adverse visual impact on the immediate and wider surrounding area to the detriment of the classification of the site as being of high landscape value and scenic significance under the Laxey and Lonan Area Plan Order 2005. As such the proposal is contrary to Environment Policy 2 of the Isle of Man Strategic Plan 2007.

3. The proposed development will result in adverse impact on the ecological interest of land designated as being of such interest under the Laxey and Lonan Area Plan Order 2005. As such the proposal is contrary to Policy L/OSNC/PR/3 of the Laxey and Lonan Area Plan Order 2005 and Strategic Policy 4, Environment Policy 1 and Environment Policy 4 of the Isle of Man Strategic Plan 2007.

Note
It is noted that the planning application is made retrospectively as development and engineering operations have already occurred on the application site. As a consequence of the refusal of this planning application the development and engineering operations are unlawful. By the 30th September 2008 a scheme of restoration for the application site must be submitted to and agreed with the Department of Local Government and the Environment. Such restoration scheme must remove the deposited material contained within the application site and appropriately grade the remaining land to a level that matches that of the surrounding field level. The works contained within the agreed scheme of restoration must be undertaken within three months of the date of agreement with the Department of Local Government and the Environment.

This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

- Any appeal has been determined;

Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
