## Town and Country Planning Act 1999

### Town and Country (Development Procedure) Order 2005

Dave Luton Design
Engine House Studio
Agneash
Lonan
Isle Of Man
IM4 7NS

In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

**Name:** Mr & Mrs Marlow
**Proposal:** Erection of a swimming pool
**at:** Ard Na Mara (Formerly Southampton Farmhouse)
Quines Hill
Port Soderick
Isle Of Man
IM4 1BA

which was considered on 17th June 2008, for the reasons set out below.

**Date of Issue:**

Murray House
Mount Havelock
Douglas

**Secretary to the Planning Committee**

### Reason(S) For Refusal:

1. By reason of its scale, form and appearance the proposed extension fails to respect the form and proportion of the existing dwelling resulting in an incongruous form of development that is detrimental to the amenity of the dwelling and the surrounding area. As such the proposed development fails to accord with the provisions of Housing Policy 15 of the Isle of Man Strategic Plan 2007.

2. The proposed extension results in a level of floor space that is greatly in excess of a 50% increase on the floor space contained within the original dwelling. As such the proposed development fails to accord with the provisions of Housing Policy 15 of the Isle of Man Strategic Plan 2007.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
