In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

which was considered on 20th June 2008, for the reasons set out below.

### Reason(S) For Refusal:

1. The proposed use of the site for the storage of vehicles in an area identified as Open Space by the Foxdale Local Plan would be contrary to the land zoning of the site and would be detrimental to the amenities of the surrounding area.

2. It is considered that the number of vehicles using site would have an adverse impact upon the highway safety of the surrounding area. The existing narrow and steep track which serves the site combined with vehicles parked legally on the main road would result in access arrangements that would be inadequate to serve the proposed use of the site.

3. The increase in activity generated in the movement of vehicles would result in an unacceptable level of noise and disturbance to neighbouring dwellings

**Note**
Within 28 days of the decision notice becoming final, all extraneous vehicles must be removed from the site and only vehicles associated with the residential use of Brookfield House shall be parked on-site.

- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
