### Officer's Report

#### The Site

The site represents the land associated with and including a small derelict cottage which is situated on the eastern side of the A3 Ballamodha Straight towards the top end, north of the Corlea Road/Solomon's Corner. The cottage sits with its gable to the road with more land to the east. The cottage has most of its walls and a corrugated tin roof. The principal walls of the cottage itself are intact and the eastern annex had at the time of the consideration of the most recent application, only three of its original walls and no roof.

#### Planning Status

The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Open Space (white land).

#### Planning History

Following a refusal of permission for renovation and extension of the property, permission was granted for the renovation of the property without extension - PA 06/1556. The property has now

been sold and the new applicants now wish to modify the permission which has been granted. The easternmost part of the property has been demolished.

## The Proposal

The proposed change from the approved scheme represents only in new window and doors in the existing and proposed structure. The existing structure will now have a new window aperture in the front of the western annex, a window in the rear of this, two new windows in the rear of the main part of the cottage, a new door and window in the rebuilt eastern annex and a new window in the front of the rebuilt eastern annex. The footprint remains the same as permitted. The permitted rooflights in the rear pitch are to be omitted, a chimney added to the gable of the new eastern annex and five new rooflights in the front pitch. The roofing is to be natural slate.

The access drive is shown to be a slightly different shape to that which has permission and encroaching further into the field to the east than is shown in the permitted scheme.

The applicant has submitted an updated structural engineer's report which confirms that with buttressing the principal walls may be retained and the scheme undertaken without compromising the integrity of the remainder of the building.

### Representations

Malew Parish Commissioners raise no objection The Fire Prevention Officer requests the installation of smoke detection which is dealt with as part of the Building Regulations and as such is not a planning matter and should not be referred to in the decision notice.

### Assessment

The scheme is little different from that which already has approval. The main difference is the extension of the residential curtilage into the field to the east. However, after discussion with the applicants and the applicants' agent this has been modified and comes closer to the dwelling but not quite as close as in the approved scheme. The applicant has put this access in place on the site and it does not appear to encroach into the land beyond what is a reasonable residential curtilage. The site defined in red on the plans is however far beyond the residential curtilage and a condition should be attached to this effect, restricting the curtilage to a depth not exceeding the area defined by the eastern side of the access road.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Fire Prevention Officer requests the installation of smoke detection which is dealt with as part of the Building Regulations and as such is not a planning matter. The Fire Prevention Officer should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the renovation of the existing building and extension and creation of access, all as shown in drawings 07 0315-02 and -03 and the structural survey all received on 25th February, 2008 and -01A received on 9th May, 2008.

C 3. Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2005 (or any Order revoking or re-enacting that Order) no extensions, greenhouses, walls, gates, fences, garden sheds, summerhouses, flag poles, decking, garages, or tanks for the storage of oil for domestic heating shall be erected (other than those expressly authorised by this approval.)

C 4. The roof(s) must be finished in dark natural slate. C 5. No approval is hereby granted to the use as residential curtilage of all of the land edged red on the submitted plans. The residential curtilage shall exinef no further east than the access road as shown in the approved plans.

C 6. Any trees removed to make way for the access must be replaced with species already found on site. These trees must be introduced in the first planting season following the removal of the trees they are to replace.

C 7. All windows must be timber framed and installed as shown in the permitted drawings unless otherwise authorised by the Planning Authority.
