## Officer's Report

### The Application Site

1. The application site comprises a two storey end of terrace dwelling house situated on a relatively new residential estate on Audlyn Walk, Ramsey.

### The Proposal

2. The proposal is for the erection of an attached single garage to the side of the house. The roof materials and rendered walls will match the existing house.

### Planning History

3. There is no planning history of specific relevance to this application.

### Planning Policy

4. The site is zoned for mixed use residential and industrial use in the Ramsey Local Plan 1998.

5. General Policy 2 of the Isle of Man Strategic Plan 2007 is relevant:

'Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

- (a) is in accordance with the design brief in the Area Plan where there is such a brief;
- (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) does not affect adversely the character of the surrounding landscape or townscape;
- (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses;
- (e) does not affect adversely public views of the sea;
- (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks;
- (g) does not affect adversely the amenity of local residents or the character of the locality;

- (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space;
- (i) does not have an unacceptable effect on road safety or traffic flows on the local highways;
- (j) can be provided with all necessary services;
- (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan;
- (I) is not on contaminated land or subject to unreasonable risk of erosion or flooding;
- (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and
- (n) is designed having due regard to best practice in reducing energy consumption.'

## Representations

6. Ramsey Commissioners - no response at the time of writing.
7. Highways division - no objection subject to a condition that advises the applicant to contact the Network Operations Section of the Department of Infrastructure, prior to carrying out any works with the highway, including the installation of dropped kerbs.

### Assessment

8. The proposal is for the erection of an attached single garage to the side of the house. The garage would appear subservient and in keeping with the appearance of the main house. External materials would be used to match the existing.
9. It is considered that there are no issues of impact on neighbours or loss of amenity. Sufficient off-street parking would be retained for the property.
10. The Highways Division has asked for a condition requiring the applicant to contact the Network Operations section before carrying out any works. However, this would be more appropriately relayed to the applicant by way of a note. Such a condition would not meet the necessary tests including the fact that it does not relate to planning.
11. In conclusion, it is considered that the proposal complies with the relevant policy and that there are no material considerations that indicate that permission should be refused.

### Recommendation

12. It is recommended that the planning application be approved with conditions.

13. The Highway Division is part of the Department of Infrastructure and does not therefore benefit from Interested Party Status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval for the erection of a garage/store to the side elevation relates to the application form and Drawing Number 689.01, all received on 12 April 2013 N 1. The applicant is advised to contact the Network Operations Section of the Department of Infrastructure, prior to carrying out any works with the highway, including the installation of dropped kerbs. This is to check when any further separate authorisation is required to carry out works to the highway. The Section's contact number is 686665.

N 2. The applicant should note that this approval does not authorise the undertaking of any works on, over or under land which is not within the applicant's ownership or control, including foundations and guttering associated with the development hereby approved.

I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager/ Senior Planning Officer.
