If the Planning officer is minded to allow the application the Commissioners would ask that consideration be given to the lack of feature on the east elevation (facing the main road). This would benefit from, say, windows to take away the slab-sided industrial appearance of the featureless wall.

## THE SITE

The site represents the curtilage of a property which was created from the conversion of a former garage, located on the corner of the A5 Castletown Road and the Clanagh Road (B37). The site accommodates the dwelling and access from the B37.

### Planning Status

The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as Residential.

### Planning History

The following applications have been submitted in respect of this site:

- PA 01/2125 - change of use of granny flat to separate dwelling - refused
- PA 03/1076 - creation of new driveway and access and change of use of associated lodge to separate dwelling - permitted
- PA 05/2008 - erection of single storey extension to rear elevation to provide bedroom and bathroom and retrospective application for conservatory and fencing - permitted.

### The Proposal

Proposed here is the erection of a double garage between the house and the Clanagh Road. The garage would be 5.5m square with a pitched roof whose ridge runs parallel with that of the main dwelling.

### Assessment

Department of Transport Highways and Traffic Division have indicated that the garage should be relocated 2m further towards the Main Road to enable better turning facilities for vehicles to be parked in the garage.

The applicant has now submitted further plans showing the relocation of the building to better accommodate the access as was recommended by the Department of Transport – drawing reference 0428/PL20B received on 19th September, 2006. The garage is now in line with the rear of the dwelling and close to the Clenagh Road but due to its set back from the Main Road there will be no impediment to visibility for those in vehicles emerging onto the A25 from the Clenagh Road.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Whilst Manx Electricity Authority represent a statutory authority, the points raised in correspondence relate to building practices and not strictly planning and as such should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the erection of a garage as shown in drawings reference 0428/PL20/B received on 18th September, 2006.

C 3. The garage may only be used for the storage of vehicles in association with Clanagh Lodge.

C 4. There must be no discharge of surface water to the main foul sewer.

N 1. The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687705) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.

The applicant is also advised to contact the M.E.A. for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
