In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to drawing no.s 007/001, 007/002, 007/003, 007/004, 007/006, 007-100, 007-101, 007-102, 007-110, 007-111, 007-112, 007-120, 007-121, 007-122, 007-123, 007-124, 007-130, 007-131, 007-132, 007-133, 007-134, 007-140, 007-141, 007-142, 007-150, 007-151, 007-152, 007-153, 007-154, 007-160, 007-161, 007-162, 007-163, 007-170, 007-171, 007-172, 007-180, 007-181, 007-182, 007-190, 007-191, 007-192, 007-200, PL257/1 rev. B and PL257/2 rev. B date stamped 23rd June 2006.

3. Prior to the commencement of any works on site, there must be concluded between the applicant/developer and the Department of Local Government and the Environment a formal agreement whereby a minimum of nine units within the development will be made available to the aforementioned Department as affordable housing units in accordance with the House Purchase Assistance Scheme 2004.

4. All planting, seeding or turfing comprised in the agreed scheme, as shown within drawing no.s PL257/1 rev. B and PL257/2 rev. B, must be carried out in the first planting and seeding seasons following the completion of the development or the occupation of the dwellings, whichever is the sooner. Any trees or plants which within a period of five years from the completion of the development die, are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of a similar size and species.

5. The proposed development must be connected to the main foul sewer.

NOTE: A Drainage Connection Fee will be payable to the Drainage Authority on this development

6. There must be no discharge of surface water to the main foul sewer.

7. No dwelling shall be occupied until the estate road has been constructed to at least base course level and adequately lit from the junction with the adopted highway up to the access to the dwelling to the satisfaction of the Planning Authority after consultation with the Highway Authority.

8. Prior to the commencement of development on the application site details of the kickabout court facilities (including fencing and screening details) must be submitted to and agreed in writing by the Planning Authority. Thereafter, prior to the occupation of any of the dwellings on the application site the kickabout court facilities must be set out in accordance with the agreed details and be capable of use to the satisfaction of the Planning Authority.

NOTE The applicant/developer is recommended to contact the Isle of Man Fire and Rescue Service to discuss the provision of appropriate fire precaution measures.

NOTE The applicant/developer is recommended to contact the Isle of Man Water Authority to discuss the provision or change of any water supply.

NOTE The applicant/developer is recommended to contact the Manx Electricity Authority to discuss the provision or change of any electrical supply.

NOTE The applicants attention is drawn to the report of the Disability Access Officer, a copy of which is attached.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

You should note that a copy of the Officer's report which led to the decision being made, along with any correspondence relative to the application, is available for inspection at the Department.

The proposed development must not be commenced until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.
