### Officer's Report

#### The Site

The application site represents a converted former horticultural building to the north of the A23, Mount Rule Braddan.

The property is of stone construction with a slate roof and currently benefits from a detached double garage located to the rear.

## Planning Status

The site is located within an area zoned as Open Space (agriculture) in the Braddan Parish District Local Plan (Planning Circular 6/91.

## Planning History

There following previous planning application is considered relevant to this application:

PA 94/00683 – Change of use from horticultural unit to residential unit, Virginia Barn, Mount Rule, Braddan – approved at appeal 18th July 1995.

## Representations

Braddan Commissioners recommend that the application be refused, based on the approval granted in 1995 which stated that no further extensions to the property would be permitted. The Department of Transport Highways Division, MEA and Chief Fire Officer do not object subject to the imposition of conditions should the application be approved.

## The Proposal

The application proposes the construction of a two storey extension to the rear of the property and construction of an attached garage to the side elevation. In addition, it is proposed to provide new gates to the access driveway.

## Assessment

Planning permission was granted for the conversion a Note was attached which indicated that “no further extension of the building is likely to be permitted”. In considering applications for planning permission, each application considered on its merits, being mindful of guidance published by the Department, in this case Planning Circular 3/89 which relates to the Renovation of Buildings in the Countryside.

In this particular application, the building it is proposed to extend does not immediately present itself as a renovated former barn, whether used for agriculture or horticulture in the past. It does however, appear as a traditional dwelling, sympathetically renovated and maintained. As such, it is considered that the two storey extension proposed at the rear would appear as a subordinate and sympathetic addition, as would the garage it is proposed to construct to the side elevation and it is therefore recommended that the application be approved.

The condition suggested by the Department of Transport Highways Division is noted, however, given that the access is existing and it is proposed to replace the gates only, it is not considered appropriate to attach a condition relating to visibility splays.

## Party Status

It is considered that all parties who made who made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the plans and information submitted as part of this application and date stamped 12th May 2006 and 22nd June 2006.

C 3. The external finishes of the extension must match those of the existing building in all respects.

C 4. The exterior stonework must be of a traditional nature.

NOTE: Split stone on a backing render is not acceptable as an external finish.

N 1. PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.

N 2. The applicant is advised to consult with the M.E.A. to determine the clearance required from the (overhead high tension line) or (the underground cable) which crosses the site.
