In pursuance of their powers under the above Acts and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the application made by you

a) Change of use of waste land to storage area for builder's materials, land to rear of Haydn Minay Ltd, off Church Road, Onchan which was considered at a meeting held on the 16 August 1996, for the reasons set out on the attached schedule, numbered 1 to 3. Date of Issue: August 1996

Note 1: The decision contained in this notice does not become final until -

a) the time for requesting an appeal in relation to any decision at review has expired; or
b) any appeal has been completed.

Note 2: Rights of appeal against the decision of the Planning Committee are attached.

Note 3: An appeal may be requested within a period of 21 days. No works may be commenced until such time as the applicant has received notification that an appeal has not been lodged.

1. The proposed use is considered inappropriate in an area so close to existing dwellings in terms of the impact of this use from the levels and type of vehicular traffic entering and exiting the site and the general appearance of the site as viewed from adjacent properties.

It would also seem illogical to approve and encourage a use which has previously led to the serving on the owners of the site, of a Notice under Section 14 of the Local Government (Miscellaneous Provisions) Act 1984 and which, in turn led to an order to remove all builders' materials, plant, equipment etc. from the site.

2. The access to the site is considered inadequate for the use of the site as proposed.

3. Furthermore, the use is likely to increase the incidence of heavy goods vehicles within the Conservation Area which is considered detrimental to its amenities.

NOTE: The applicant is encouraged to consider a residential use of the site or something associated with domestic use - e.g. private car garaging.
