In pursuance of his powers under the above Act and Order, the Minister for Infrastructure, does hereby REFUSE planning application 12/01312/B by John Blatcher for Erection of a dwelling, Lane at Ramillies, Clay Head Road, Baldrine for the following reason(s):

1. Whilst it is accepted that the removal of the six trees identified within the planning application is unlikely to affect the amenity of the area to an extent that would warrant refusal on such basis, it has to be recognised that policy L/OSNC/PR/6 of the Laxey and Lonan Area Plan Order 2005 sets out a general presumption against the removal of trees to facilitate development. Furthermore, and more importantly, it is concluded that the erection of the dwelling is likely to lead to further future tree removal from the application site which would be unacceptably harmful to the amenity of the area. As such, the proposal is deemed contrary to the provisions of policy L/OSNC/PR/6 of the Laxey and Lonan Area Plan Order 2005 and General Policy 2 (c & g) of the Isle of Man Strategic Plan 2007.

2. The proposed development would result in an increased level of traffic along Clay Head Road. Due to the restricted width and alignment of substantial sections of Clay Head Road it is concluded that this road cannot satisfactorily accommodate such increased level of traffic. Furthermore, as visibility at the junction of Clay Head Road and the A9 is known to be substandard any increase in use would be contrary to the interests of highway safety. As such, the proposed development would have an unacceptable impact on existing traffic flow and highway safety contrary to the provisions of General Policy 2 (i) of the Isle of Man Strategic Plan 2007.
