## Officer's Report

### Introduction

1. This application seeks permission for the installation of replacement windows in the front elevation of a residential property. The application is considered to be acceptable and is in accordance with the relevant policies of the Isle of Man Strategic Plan.

### The Site

2. The application site is the curtilage of 21 Mona Street, Peel which is a three storey mid terrace property situated to the eastern side of the highway. The property is a traditional mid terrace which has retained its original sliding sash at first and second floor, the ground floor window is a timber casement.

### The Proposal

3. The application seeks approval for the installation of replacement windows in the front elevation. The windows would be uPVC sliding sash.

### Planning History

4. There have been a number of previous planning applications for the installation of replacement windows in the front and rear elevations. These applications were approved.

### Development Plan Policies

5. The application site is in an area zoned as "Mixed Use" identified on the Peel Local Plan 1989. It is also within the Peel Conservation Area. It is appropriate to consider Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007) and Planning Circular 1/98.

Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development.

If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would readily be visible from a public thoroughfare must have the same method of opening as the originals. Whatever the

material used in their construction, the windows must have the same pattern and section of glazing bars and the same frame section as the original windows.

Windows not readily visible from a public thoroughfare must have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in the construction.

### Assessment

9. The existing windows in the first and second floors are timber sliding sash, the ground floor window is a timber casement. The replacement windows would be uPVC sliding sash. Whilst the replacement windows would not be constructed of timber, they would preserve the original method of opening. The replacement window in the ground floor would be replaced with a sliding sash window; this is considered to enhance the character and appearance of the property.

10. The proposed windows would contribute to the character and appearance of the property and therefore the Conservation Area.

11. For the above reasons the application is considered to be acceptable and is recommended for approval.

### Party Status

12. The local authority, Peel Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
