# Refusal Decision Notice

## Town and Country Planning Act 1999

## Town and Country (Development Procedure) Order 2005

Mr Benjamin Corkish
22 Allan Street
Douglas
IM1 3DH

In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

Name: Mr Benjamin Corkish
Proposal: Change of use from existing storage building to a health and fitness facility
at: Store Shed / Workshop
Elm Tree Road
Onchan
Isle of Man
IM3 4EF

which was considered on 24th July 2009, for the reasons set out below.

Date of Issue: 27th July 2009

Murray House
Mount Havelock
Douglas

Deputy Secretary to the Planning Committee

## Reason(S) For Refusal:

1. Due to the construction of the building and the type of activity proposed within the building it is concluded that the proposed use would cause unacceptable noise and general disturbance to the amenity of the local residents. As such, the proposed change of use is contrary to General Policy 2 (g) of the Isle of Man Strategic Plan 2007.

2. The proposal fails to provide sufficient car parking to serve the proposed use to the detriment of the surrounding area. As such, the proposed change of use is contrary to General Policy 2 (h) and Transport Policy 7 of the Isle of Man Strategic Plan 2007.

This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
