### Officer's Report

#### The Site

The application site comprises of the curtilage of 23 Market Street, Peel which is a traditional two storey terraced property located south of Shore Road and west of Queen and Charles Street.

#### The Proposal

The proposed application seeks approval for the replacement of the windows to the front and rear elevations of the property. A "Conservation" type roof light would be installed to the front and rear elevations of the property.

Alterations to the rear out building would include, re-roofing and the installation of two 1160mm x 1000mm roof lights. The backyard would be re-paved with the installation of a new external oil fired boiler to the rear of the property.

#### Planning Status

In terms of local plan policy, the application site is located within an area designated as being "Mixed Use" and within the "Conservation Area" under the Peel Local Plan, 1989. There is a policy within the

Peel Written Statement (Planning Circular 6/89), which is considered specifically material to the assessment of this current planning application – Policy 9.16 states:

"Particular attention will be paid to the alteration or extension of a building within the Conservation Area which must be carried out in a manner sympathetic to the existing building and its setting".

The Isle of Man Strategic Plan 2007 contains two policies which are considered specifically material to the assessment of this current planning application - General Policy 2 states:

"Development which is in accordance with the land-use zoning and proposals in the appropriate Area Plan and with other policies of this Strategic Plan will normally be permitted, provided that the development:

- (a) is in accordance with the design brief in the Area Plan where there is such a brief;
- (b) respects the site and surroundings in terms of the siting, layout, scale, form, design and landscaping of buildings and the spaces around them;
- (c) does not affect adversely the character of the surrounding landscape or townscape;
- (d) does not adversely affect the protected wildlife or locally important habitats on the site or adjacent land, including water courses;
- (e) does not affect adversely public views of the sea;
- (f) incorporates where possible existing topography and landscape features, particularly trees and sod banks;
- (g) does not affect adversely the amenity of local residents or the character of the locality;
- (h) provides satisfactory amenity standards in itself, including where appropriate safe and convenient access for all highway users, together with adequate parking, servicing and manoeuvring space;
- (i) does not have an unacceptable effect on road safety or traffic flows on the local highways;
- (j) can be provided with all necessary services;
- (k) does not prejudice the use or development of adjoining land in accordance with the appropriate Area Plan;
- (l) is not on contaminated land or subject to unreasonable risk of erosion or flooding;
- (m) takes account of community and personal safety and security in the design of buildings and the spaces around them; and
- (n) is designed having due regard to best practice in reducing energy consumption."

Environment Policy 35 states:

"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

### Planning History

The application site has had no previous planning applications.

### Representations

The Department of Transport Highways Division and Peel Town Commissioners have not commented on the proposal.

Mr Crookall MHK has requested that he be kept informed of this and all other applications in the Peel area.

### Assessment

The application site is located identified as being within the area of mixed use in Peel and given the nature of the proposed development it is therefore appropriate to assess the proposal against the policy identified earlier within the report (i.e. Policy 9.16 of the Planning Circular 6/89, General Policy 2 and Environment Policy 35 of Isle of Man Strategic Plan 2007).

It is considered that the proposed alterations would be acceptable in that they would respect the application site and surroundings in terms of the form and design. The design of the proposed replacement windows, being timber sliding sash, would be in-keeping with the existing building and the surrounding area and would be sympathetic to its setting. Indeed the installation of timber sliding sash windows would enhance the character of the Peel Conservation Area.

The alterations to the rear out building are regarded as being minor and would be appropriate for the area, without adversely affect the amenity of local residents.

### Recommendation

For these reasons the proposal is considered acceptable and it is recommended that the planning application be permitted.

### Party Status

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:

- The Department of Transport Highways Division
- Peel Town Commissioners

Accordingly the following parties are not granted Interested Party Status:

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the installation of replacement windows and alterations to 23 Market Street Peel as shown by the submitted drawings P01 and P03 received on 25th November 2008 and amended drawing P02 rev B received on the 8th December 2008.

C 3. All windows on the front elevation must be timber sliding sash.

C 4. All roof lights must be "Conservation" or "Heritage" style.

I confirm that this decision accords with Government Circular No 56/08 (Delegation of Functions to the Acting Senior Planning Officer), GC 55/08 for Advertisements and 69/08 for Registered Buildings.
