### Officer's Report

#### The Site

The site represents that of an existing garage block on the eastern side of Mill Street, in between numbers 34 and 32 Mill Street - two existing residential properties, and to the rear of number 33, Hope Street - another dwelling.

#### Planning Status

The site lies within an area designated on the Castletown Local and draft Area Plan as Residential and also within Castletown's Conservation Area.

#### Planning History

Planning permission was sought and granted for the replacement of the garages with a dwelling under PA 08/0584.

#### The Proposal

Proposed here is the erection of a dwelling, amended from the scheme which has approval. The changes proposed include the erection of a garage on the southern side of the new dwelling and the

relocation of the dwelling further to the north, towards number 34. The garage partially encroaches into the land which previously belonged to number 32 but the application is to undertake an exchange of land to better facilitate access to both properties and an amended boundary is shown on the proposed drawing.

### Representations

Department of Transport Highways and Traffic Division do not oppose the application and they note that a previous objection was over-ruled by the planning authority. This objection related to the loss of garaging but the applicant indicated that the garaging was not available to others and therefore the loss of the garaging would not be objectionable.

Department of Transport Drainage Division recommend conditions regarding the connection of the development to the mains system and that no surface water should be discharged to the main sewer. The application states that this will be the case so there is no requirement for such conditions.

### Assessment

The proposed changes make little visual difference to the approved scheme. A condition was attached to the previous approval to require that the windows in the first floor of the rear elevation should be fitted with glass obscured to Pilkington Level 5 or equivalent in perpetuity to prevent overlooking of 33, Hope Street. This should be reiterated in any approval of this application.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the demolition of the existing garages and the erection of a dwelling and parking all as shown in drawings 4230/L1, -S1, -S2 and -P1 all received on 8th December, 2008.

C 3. The windows in the first floor of the rear elevation should be fitted with glass obscured to Pilkington Level 5 or equivalent in perpetuity to prevent overlooking of 33, Hope Street.
