### Officer's Report

#### The Site

The site represents a piece of land which lies between 33, Malew Street and Bagnio House which sits on Arbory Street. The area edged in red accommodates an outbuilding with car parking alongside.

#### Planning Status

The site lies within an area designated on the Castletown Local Plan of 1991 and the draft Castletown Area Plan of 2001 as Predominantly Residential. The site also lies within Castletown's Conservation Area.

#### Planning History

Planning permission was sought for the demolition of the existing outbuilding and construction of new garden room, games room and garage under PA 90/0221 and the installation of new air conditioning unit to the front elevation of 33, Malew Street was refused under PA 99/0291.

#### The Proposal

Proposed is the construction of a flat roofed garage in the place of one of the parking spaces, alongside the outbuilding. The garage will be the same height as the walling behind the parking spaces with a garage door to match those already in the outbuilding.

#### Representations

Department of Transport Highways and Traffic Division indicate that they do not oppose the application.

### Assessment

Despite being within the Conservation Area, the building is some distance from the road and not visible to the public. The proposed works do not detract from the appearance of the building alongside, which is relatively modern and as such the proposal will not contravene the provisions of Environment Policy 35 which requires development to preserve or enhance the Area.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
