### Officer's Report

#### The Site

The application site represents the curtilage of 3 Aspen Drive, Ballawattleworth, Peel. The property is a semi-detached, two storey dwelling with a south facing rear garden, the rear boundary of which is shared with adjacent properties on Maple Avenue.

#### The Proposal

This application seeks retrospective planning approval for the erection of a garden shed. The shed is positioned at the end of the garden and measures 2.6 metres and has a floor area of approximately 6 metres by 3.6 metres (floor area 21.7 metres). There is an existing shed within the site which has been erected under the provisions of the 2005 Permitted development Order (PDO). The shed which is the basis for this application requires planning approval as it is larger than that allowed under the Permitted Development provisions and represents the 2nd shed on the site (only 1 is permitted under the PDO).

#### Planning Status

The application site is located within an area identified as being residential use by the Peel Local Plan.

## Planning History

The following previous planning application is considered relevant in the assessment and determination of this application:

03/01553/B sought approval for the erection of a first floor extension above the existing garage. This was approved.

## Representations

The Department of Transport Highways Division does not object to this application. Peel Town Commissioners do not object to this application. Mr Crookall MHK has expressed an interest in this application.

## Assessment

The main issues to be considered in the assessment of this application are the impact of the proposed shed upon neighbouring properties and the surrounding area in general.

The shed is to be used for domestic storage such as children's toys and gardening equipment. It is not judged that such a use would result in any adverse impact such as noise and disturbance or overlooking. The shed itself is relatively large by domestic standards however the rear garden of the proposal site and those of adjacent neighbours are sufficient to provide a reasonable separation distance from the shed. The maximum ridge height of 2.6 metres is considered acceptable, particularly given that a boundary fence of up to 2 metres van be erected under the provisions of the PDO.

It is judged that the proposed shed is acceptable in this particular case given the size of rear gardens and the use of the shed for storage purposes.

## Recommendation

Permit.

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:
