In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **REFUSE** the following application made on behalf of:

which was considered on 19th March 2009, for the reasons set out below.

### Reason(S) For Refusal:

1. The proposed redevelopment of the site would be contrary to Policy CA/6 of Planning Policy Statement 1/01 and Environment Policies 35 and 39 of the Isle of Man Strategic Plan 2007 in that no proper assessment has been carried out to assess the merits/justification for the demolition of the existing building. It is considered that the demolition of the existing building would adversely affect the character and appearance of the Conservation Area.

2. The proposed development would be contrary to General Policy 2 and Environment Policy 35 of the Isle of Man Strategic Plan 2007 and Planning Policy Statement 1/01 by reason of its height, design, massing and external appearance in that it would introduce a prominent and incongruous development within the streetscene which would not preserve or enhance the character and appearance of the Conservation Area and would be detrimental to the visual amenities of the locality.

This decision was made by the Acting Senior Planning Officer in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
