In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **REFUSE** the following application made on behalf of:

which was considered on 20th February 2009, for the **reasons** set out below.

### Reason(S) For Refusal:

1. The design, height, prominent location and appearance of the proposal would be detrimental to the visual amenity of the property and the surrounding area and would set an undesirable precedent for future development of a similar nature along King Edward Park to the detriment of public and residential amenity within the area.

2. The proposed dwelling, by virtue of its proximity, height and length would have an overbearing impact upon the outlook of the occupiers of Nr 18 King Edward Park and thereby would be un-neighbourly and unacceptable.

This decision was made by the Acting Senior Planning Officer in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
