### Officer's Report

The applicants are seeking to vary condition 4 of 08/00924 to allow for financial and profession services (Use Class 2) to use the proposed building.

The building illustrated as being an office may only be used in accordance with Class 4 of the Isle of Man Planning (Permitted Development) Order 2005 Schedule 4 and the cafe element as shown in the approved plans may be used for the sale of hot and cold food for consumption on the premises and the sale of hot or cold food for consumption off the premises.

The applicant’s have indicated that they would like Classes 2 (a) and (b) [Financial and Professional Services] to be allowed to be operated from the proposed building as they consider these uses to be acceptable within a town centre location. They do not envisage the building to be used for Classes 2 (c) to (e) [betting shop, booking office for a driving school and a job centre] and would be content to those uses to be excluded.

The site is zoned as predominantly offices and such uses can be found within such area. I consider the proposed uses to be compatible with the land use zoning within the Douglas Local Plan. I therefore recommend that planning permission be granted subject to conditions.

#### C 1.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

#### C 2.

This permission relates to the demolition of all buildings on site and the erection of a new office building with cafe and landscaping, all as shown in drawings reference office-existing03, -4, office-ae05a, -ae07, -ae08, -ae10, -as01a, -as02, -ap01a, -ap22b, -ap28a, -ap29b, -ap30a, -ap31a, -32a, -ap33 all received on 6th May, 2008, approved as part of Planning Permission 08/00924/B granted on 30th September 2008.

#### C 3.

No development may commence on site, including demolition of any structure, until such time as there is in place a legal agreement which illustrates how 43 parking spaces are to be provided within a convenient walking distance (400m) of the site. The building may not be occupied until such spaces are available for use by occupants of the permitted building.

#### C 4.

The building illustrated as being an office may only be used in accordance with Classes 2 (a), 2 (b) and 4 of Schedule 4 of the Town and Country Planning (Permitted Development) Order 2005 and the cafe element as shown in the approved plans may be used for the sale of hot and cold food for consumption on the premises and the sale of hot or cold food for consumption off the premises.

I confirm that this decision accords with Government Circular No 56/08 (Delegation of Functions to the Acting Senior Planning Officer), GC 55/08 for Advertisements and 69/08 for Registered Buildings.
