### Officer's Report

#### The Site

The site defined in red represents the area of two new barns which have recently been constructed in association with Orrisdale Farm, whose farm buildings all lie to the southwest of the site and are within the area defined in blue. The buildings are built close to the highest part of the hill top with bunding around them. The buildings are each 44m long and 16m wide.

#### Planning Status

The site lies within an area of an Area of High Landscape or Coastal Value and Scenic Significance on the Isle of Man Planning Scheme (Development Plan) Order 1982.

#### Planning History

Planning permission was granted for the erection of an agricultural building under PA 00/1161 and permission then refused for a relocation of the building to a position close to where the buildings were finally built, under PA 01/1183. Permission was granted for the buildings which are presently on site under PA 05/0540. Permission has been granted for the erection of farm worker's dwellings in association with the farm but this is not relevant to the consideration of this latest application.

## The Proposal

Proposed now is the covering over of the area between the buildings, effectively creating a third building of the same size and proportions as those already on each side. Presently there is a grassed area between the buildings and a walkway around each.

### Representations

Malew Parish Commissioners do not object to the application but express concern about the disposal of surface water.

### Assessment

The proposed development will create a sizeable new building but within two existing structures and as such its impact will be negligible in terms of how it will appear in the landscape. Surface water will be channelled to the soakaways which serve the existing two buildings and the amount of surface water channelled in this fashion rather than falling directly onto the grassed area between the buildings is not likely to have a significant impact bearing in mind the size of land around the buildings to which the water will eventually drain.

Environment Policy 15 requires that where the Department is satisfied that there is an agricultural need for the building sufficient to offset the presumption against building in the countryside, the building must be sited to as to reduce its impact as far as possible and siting the building as close as possible to existing building groups. In this case the building is associated with a very successful agricultural operation which has justified two new dwellings and whose employees won a significant award at this year's Royal Agricultural Show (Press release "The Kermode family of Orrisdale, Ballasalla, took the supreme trophy in the Grand Parade with their three-year-old Millbrow Adam stock bull"). The visual impact of the new building will be very limited and the building complies with Policy 15 in all other respects.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

### C 1.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

### C 2.

This permission relates to the covering over of the area between the two existing agricultural buildings, as shown in drawings K/39/3A and -6 both received on 2nd September, 2008.

C 3. The building must only be used for agricultural purposes.
