### Officer's Report

#### The Site

The site represents the residential curtilage of an existing property situated on the lower promenade in Port Erin. The site accommodates a semi-detached property which has a detached garden in front of the property, separated from the cottage by a public thoroughfare. There is to the rear a steep bank which leads upward to the upper Promenade opposite St. Catherine's Church.

#### Planning Status

The site lies within an area designated as Tourism/Residential on the Port Erin Local Plan of 1990.

#### Planning History

Planning permission was sought and granted for the erection of a three storey dwelling on the site to replace the existing property under PA 03/0897.

#### The Proposal

Proposed now is an amendment to the approved scheme. The changes take the form of changes to the plain rendered gable to stone, changes to the size and proportions of the first floor sliding sashes to match those on the property to the left, the second floor window is to be changed from a single light to three windows, with a central round headed window to match more closely the window in the property to the left and changes to the garage door and pedestrian door alongside to set it in from

the boundary with the adjoining property, with a shallower arch to the garage door and slightly different styled door and the omission of the timber detailing above the second floor window.

### Representations

Department of Transport Highways and Traffic Division and Port Erin Commissioners raise no objections to the application. Port Erin Commissioners recommend the services of a structural engineer in respect of the design of the retaining wall at the rear of the site. This was not referred to by the Commissioners in the earlier application and the stability of the slope and the construction of the extension is a matter for the Building Regulations, not planning.

### Assessment

The proposal represents the same scheme in terms of the size and style of extension as has already been permitted under PA 03/0867. the changes to the detailing all represent a more sympathetic approach to the building and one which will enable the building to fit in with its neighbours more comfortably than would the approved scheme.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the erection of a dwelling as shown in drawings 1, 2 and 3 all received on 15th September, 2008.

C 3. The windows must be installed as shown in the approved drawings - with those in the front elevation being sliding sashes and notwithstanding the provisions of the Permitted Development Order, may not be replaced without the authorisation of the Planning Authority.
