In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 27th November 2008, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This permission relates to the continuation and extension of the quarrying at the application site as shown and described in Figures 3.1, 3.2, 3.3, 3.4, 3.5, 3.6, 6.1, 6.2, 6.3, 6.4, 6.5, 6.6. The development must be undertaken in accordance with the phasing and restoration proposals shown in the approved plans.

3. Planting must be undertaken in accordance with that shown in the approved plans.

4. A survey for lizards must be undertaken in the first available season following the issue of this approval and thereafter monitoring undertaken in accordance with a scheme to be

approved by the Planning Authority after consultation with the Department of Agriculture, Fisheries and Forestry.

5. Extraction within the quarry may take place only between 0600hrs and 2000hrs Monday to Friday inclusive and between 0600hrs to 1400hrs on a Saturday. Despatch of material may be undertaken only between 0700-1700hrs Monday to Friday.

NOTE The applicant is advised to contact the Environmental Protection Unit of the Department of Local Government and the Environment to determine the need for a disposal licence in addition to the planning permission hereby granted.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

### Guidance Note

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

Please note that a copy of the Officer's report which led to the decision, together with correspondence relative to the application, is available for inspection at the Department.
