### Officer's Report

#### The Site

The site represents two pieces of land which are situated on the western side of the A3 Ballamodha Straight approximately half way between Ballasalla and Foxdale. The lower portion of the site accommodates an existing dormer bungalow, Bay View and garage with the vehicular access lying to the north - an access shared with the Bay View pig farm which lies to the west and south. The land to the north of the vehicular access is open, undeveloped land.

#### Planning Status

The site lies within an area designated on the Isle of Man Planning Scheme (Development Plan) Order 1982 as "white land", that is not designated for development.

#### Planning History

Aside from the applications for the development of the pig farm, Bay View itself has been the subject of two recent applications - PA 07/1873 for the alterations and erection of extensions and PA 08/0122 and the erection of a garage - both permitted.

#### The Proposal

Proposed here is the erection of stabling to the south of the dwelling. The stabling will have a footprint of 4m by 11.3m with an additional 5m by 4m annex, altogether in an L shaped structure

with shiplap clad walls and sheeted roof (green or grey) with an overall height of 4.2m. The stabling will be around 15m from the house.

### Representations

Department of Transport Highways and Traffic Division raise no objection subject to the stabling being used for private use only.

Malew Parish Commissioners raise no objection to the application.

### Assessment

The land on which the stabling is to be erected is open, undeveloped land which has, it is assumed previously been used in association with the farm which is no longer entirely associated with this dwelling. As such, the use of the land for the keeping of animals, even domestic animals rather than agricultural, is considered appropriate. There are no buildings associated with the dwelling which could be used for stabling and the proposed building is appropriate for its purpose and limited in size and height. As such, there will be no adverse visual or other impact from the proposed development. Access to this field has presently been through the farm but will be via the curtilage of the dwelling as the farm is no longer owned by the occupant of the dwelling.

It is important that the stabling is used for the keeping of horses in association with the occupation of Bay View as the access to the site is not ideal and significant amounts of additional traffic using the entrance would not be acceptable.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
