### Officer's Report

#### The Application Site And Planning Application

The application site comprises of land on the western side of Gardeners Lane in Ramsey.

The planning application seeks approval to amend dwelling designs and dwelling/fence/driveway positions on the development approved by planning application 03/01846/B.

#### Planning History

The application site has been the subject of a number of previous planning applications. Planning approval was granted on the 25th January 2007 through 03/01846/B for residential estate development comprising of roads, plots, sewers and layout for 26 semi detached dwellings, 14 terraced dwellings, 10 apartments, 1 childrens nursery, 1 public house with managers accommodation and 2 lock up retail units.

#### Representations

Ramsey Town Commissioners have no objection to the planning application. The Department of Transport Highways Division do not oppose the planning application. The Manx Electricity Authority expresses an interest in the planning application. The Isle of Man Fire and Rescue Service express an interest in the planning application.

#### Planning Policy

In terms of land use planning, the application site is within the area covered by the West Ramsey Development Framework. This framework document was written in response to the provisions of the written statement (Planning

Circular 2/99) that supports the Ramsey Local Plan, which requires that the "development of this land should be undertaken only in accordance with an approved scheme for the whole area".

In terms of strategic plan policy, although the Isle of Man Strategic Plan contains policies identifying general planning considerations that are applicable to the assessment of a planning application it is considered that there are no specific policies within the plan that are material to the assessment of this current planning application.

## Assessment

The planning application seeks amendments to the development approved under previous planning application 03/01846/B. Whilst the overall number of amendments proposed is quite significant the impact of those amendments is suitably limited. The proposal presumably reflects alterations by the developer to reflect market demands.

It is recommended that the planning application be approved.

### Party Status

It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:

Ramsey Town Commissioners; and The Department of Transport Highways Division. It is considered that the following parties that made representations to the planning application do not meet the criteria of Government Circular 1/06 and should not be afforded interested party status:
