### Officer's Report

#### The Site

The application site represents the curtilage of 26 Shore Road, Peel. The property is a terraced two-storey dwelling which faces North onto the corner of Shore Road and Bridge Street.

#### Planning Status

The site is located within an area identified as Mixed Use by the Peel Local Plan 1989. The site is also identified as being in the Peel Conservation Area. The application is for the of replacement windows and as such is to be assessed with regard to Planning Circular 1/98 'The Alteration and Replacement of Windows', specifically Policy 6 'Buildings in a Conservation Area', which states:

"If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare MUST HAVE THE SAME method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE THE SAME pattern and section of glazing bars and the same frame sections as the original windows."

PLANNING HISTORY There have been no previous planning applications considered relevant in the assessment and determination of this application.

THE PROPOSAL The application seeks approval for the replacement of existing timber windows to the 1st and 2nd floors with treated softwood casement windows of the same design.

REPRESENTATIONS Peel Town Commissioners do not object to the application. The Department of Tourism Highways Division do not object to the application. Mr T M Crookall MHK has expressed an interest in the application.

ASSESSMENT Planning Circular 1/98 states that the replacement windows on a property in a location such as this should preferably have the same method of opening and same glazing bars as the original windows. In this instance the proposed windows match the pre-existing method of opening and glazing bar pattern and is therefore judged as being acceptable. Planning Circular 1/98 does not require that the original material is used in replacements however the proposed windows are to be treated softwood and therefore are an acceptable material.

RECOMMENDATION It is recommended that the application be permitted.

PARTY STATUS It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded interested party status:
