### Officer's Report

### The Site

The application site represents the curtilage of 13 Patrick Street, Peel. The property is a two-storey end of terrace dwelling which faces West onto Patrick Street.

### Planning Status

The site is located within an area identified as Mixed Use by the Peel Local Plan 1989. The site is also identified as being within the Peel Conservation Area. The application is for the replacement of windows and as such is to be assessed with regard to Planning Circular 1/98 'The Alteration and Replacement of Windows', specifically Policy 6 'Buildings in a Conservation Area', which states: "If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare MUST HAVE THE SAME method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE THE SAME pattern and section of glazing bars and the same frame sections as the original windows.

Windows not readily visible from the public thoroughfare must have the same or similar pattern of glazing, but not necessarily the original method of opening, whatever material used in the construction."

## Planning History

There have been no previous planning applications considered relevant in the assessment and determination of this application.

### Representations

Peel Town Commissioners have indicated no objection to this application. The Department of Transport Highways Division have indicated no objection to this application. Mr T M Crookall MHK has expressed an interest in the application.

### The Proposal

The application seeks approval for the replacement of the windows and front door to the front elevation with brown PVC windows and door.

### Assessment

Planning Circular 1/98 states that the replacement windows on a property in a location such as this should preferably have the same method of opening and same glazing bars as the original windows. In this instance the proposed windows match the existing windows but not the originals which would have been sliding sash.

After consultation with the Conservation Officer and the applicant it was agreed that although not ideal, PVC casements are acceptable. However 50/50 split casement windows with a central horizontal bar would be preferred to protect the character of the Conservation Area. On the larger ground floor window a 50/50 split casement window with a central horizontal and vertical glazing bar would be preferred. Planning Circular 1/98 does not require that the original material is used in replacements and therefore brown PVC is acceptable.

Although a timber front door would be preferred the proposed brown PVC door is semi-traditional in its design and there is only a small amount of glazing. Therefore it is judged that the proposed front door is acceptable and is an improvement on what currently exists.

### Recommendation

It is recommended that the application be permitted.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the replacement of windows and door to front elevation as shown in drawings and information 01013/1, photographs and door detail submitted and date stamped 19th May 2008.

C 3. The replacement windows must be 50/50 split casement windows with a central horizontal glazing bar. The larger ground floor window must be a 50/50 split casement window with a central vertical glazing bar and a central horizontal glazing bar.
