### Officer's Report

#### The Site

The site represents the residential curtilage of an existing property which sits on the western side of Ballacriy Park, towards the southern end of the estate and fronting onto a small cul de sac of bungalows. The site backs onto presently vacant land which has permission for residential development and public open space.

The existing dwelling is a detached bungalow.

#### Planning Status

The site lies within an area designated as Residential on the Arbory and East Rushen Local Plan of 1999.

#### Planning History

Planning permission was sought and granted for the conversion of the garage to living accommodation under PA 89/1301 and construction of a conservatory under PA 94/0523.

## The Proposal

Proposed is the removal of an existing conservatory and the erection of a rear extension to extend the kitchen, the erection of a front porch and a small extension on the right hand side of the property.

### Representations

The Isle of Man Fire and Rescue Service comments on the internal layout which is a matter for the Building Regulations and should not be referred to in the planning decision notice.

Department of Transport Drainage Division make no comment on the application. Arbory Parish Commissioners have no comment.

### Assessment

The proposed extension comes very close to the rear boundary. However, the property is single storey and the proximity of the dwelling will not affect the amenities of any existing property nor will it unduly constrain the development of the land to the rear.

### Party Status

The points raised by the Isle of Man Fire and Rescue Service are the responsibility of the Building Regulations and as such this party should not be afforded party status in this instance.

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
