## Officer's Report

### The Site

The site represents the curtilage of a developing site located on the southern side of Alexandra Road, to the east of its junction of Malew Street and Douglas Road (A3). The site formerly accommodated just a single dwelling, Northcroft which was retained and its grounds re-developed as apartments (see below). The development is well underwayin construction terms.

The apartments take the form of a single building which is L-shaped with its longest length parallel to and approximately 5 m from Alexandra Road and the return running along the eastern boundary which sits next to the rear of the Commissioners' yard, next to which is  Motors petrol filling station and car and motorcycle sales outlet.

### Planning Status

The site lies within an area which is designated as Residential on the Castletown Local Plan of 1991 and on the draft Castletown Area Plan of 2001 which was not proceeded with beyond an initial draft.

### Planning History

Planning permission was granted in principle for the demolition of the existing building and the creation of residential accommodation in the form of 10 dwellings under PA 00/1847. Permission was then granted on appeal for 23 apartments and 2 houses and alterations to the existing house - PA 02/0708.

### The Proposal

The site excludes the two dwellings which were permitted under the above permission which lie alongside Malew Street. The proposal involves the alteration of approved windows, removing two windows each on the western and eastern elevations and inserting six new windows on the northern elevation which fronts on Alexandra Road. The new windows are vertically proportioned, some double windows with central mullion and match others in the same elevation.

The windows to be altered all serve bedrooms and offer the occupants more privacy but retaining a northern view/light.

### Representations

The Manx Electricity Authority recommend a note regarding electricity supplies. As the application is for amendments to the windows this note is not relevant to the planning decision notice.

The Isle of Man Water Authority recommend a note regarding the supply of mains water to the development, which is not a material planning consideration and as such should not be referred to in the planning decision notice.

Environmental Health Officer recommends that the flats should be registered under the Housing (Flats) Regulations which is not a material planning consideration and should not be referred to in the planning decision notice.

### Assessment

The proposed changes to the windows do not adversely affect the appearance or character of the property and do not affect the privacy or amenity of those in the properties to the west, in fact windows are to be removed from the western elevation which, if anything will improve the amenities of those in Northcroft.

### Party Status

The points raised by the Isle of Man Water Authority, the Manx Electricity Authority and the Environmental Health Inspector which is not a material planning consideration and should not be referred to in the planning decision notice and these parties should not be afforded party status.

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

C 2. This permission relates to the installation of windows in the northern elevation and removal of windows in the western and eastern elevations as shown in drawings K164/P/10-01, -02 and -12-01 all received on 28th May, 2008.
