### Officer's Report

#### The Site

The application site represents the curtilage of the British Hotel, North Quay, Douglas. The property is an end of terrace public house which faces South on the corner of North Quay and Market Hill.

#### Planning Status

The site is located within an area identified as being Predominantly Shopping Use by the Douglas Local Plan 1998. The site is also identified as being within the North Quay Conservation Area.

#### Planning History

There have been no previous planning applications considered relevant in the assessment and determination of this application.

## The Proposal

The application seeks approval for the formation of a licensed pavement area with outside seating for patrons of the public house. The proposed seating area is the required 2000mm away from the road and includes the approved banner type barriers of a minimum height of 1000mm between stainless steel posts following stainless steel sockets set flush into the pavement.

## Representations

Douglas Corporation have no objection to the planning application. The Department of Transport Highways Division have no objection to the planning application. The owner/occupier of the ground floor shop and basement, 35 North Quay, Douglas have objected to the application on the following grounds:

a) the seating area would create an obstruction for pedestrian traffic b) there would be a higher congregation of people smoking and drinking outside c) increased density of smoke in the area.

The owner/occupier of Flat 1, 35 North Quay, Douglas have objected to the application on the following grounds:

a) that the proposed seating area will cause an increase in noise pollution from music (live or otherwise) from the door being propped open or from the patrons themselves, especially late into the evening b) an increase in rubbish around the area from glasses, bottles, cigarettes etc.

## Assessment

The North Quay is increasingly becoming an attractive, pedestrian friendly area with alfresco dining and drinking facilities for the establishments on the Quay. The proposed seating area is relatively small in size and is the required distance from the road. At the proposed site there is a large amount of pavement which would ensure the seating area would not have an adverse impact on pedestrian movement. The seating area is to the East side of entrance to the British Hotel and thus will have a lessened impact on the occupiers of the adjoining property. As the dwelling and public house are located in an area of Predominantly Shopping Use it is fair to assume that there will be a higher level of disturbance than in other areas from pedestrians and shoppers and frequenters of the pubs, bars and restaurants.

## Recommendation

It is recommended that the application be permitted.
