In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

### Reason(S) For Refusal:

1. Insufficient evidence has been submitted to demonstrate that the property is no longer required for occupation by an agricultural worker in the island. Accordingly the removal of the agricultural workers condition is insufficiently justified.

**Note**
The Department’s established practice in these matters is to require that the dwelling should be offered for sale for a period of 6 months at a valuation which reflects the limitation on occupancy imposed by the current planning approval; there would usually be a reduction in the free market value of approximately 25 – 30%. The Applicant is recommended to market the property at this discounted rate for a period of 6 months. If after this period the house is still on the market then the applicant is recommended to submit a further application with the relevant evidence.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

Whichever is the later.
Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
