### Officer's Report

#### Site

The application site comprises a vacant plot of land on the south eastern side Tynwald Street. To the south west of the application site is a playground and to the south west is a library. To the north east is a car park. The site is zoned as predominantly residential in the Douglas Local Plan 1998.

#### Proposed Development

The application is seeking planning permission to create a temporary car park.

#### Planning Status And Relevant Policies

Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2.

#### Planning History

There have been a number of planning applications relating to the school; however, none are considered relevant in the consideration of this application.

## Representations

Douglas Corporation has commented on the suitability of the materials to be used for the car park. Highways Division of the Department of Transport have not commented on the application. Standard comments have been received from the Manx Electricity Authority.

### Assessment

The key issue here is whether the proposal will impact on the visual amenities of the locality. The site is currently vacant, untidy and fenced off. The site is shouting out for it to be re-developed. The proposal is not an ideal use; however, at least it would clear the site and bring it back into some beneficial use for a temporary period. The application does not state how long the permission is to last. There have been similar applications within Douglas where temporary permission has been granted for 2 years. It is considered that a condition to this effect would be appropriate so as to ensure the site will not become a permanent car park.

In respect of the concerns of Douglas Corporation, these have been noted but the materials have been used on other temporary sites. The application lack any detail about the quality of the fencing. It is considered that further details should be submitted to regarding the type of timber to be used to ensure the quality of the fencing does not result in a poor appearance. A sealed surface would give the proposal more of permanent appearance and would impact on the visual amenities of the locality. The proposed materials would give the appearance that the site will only be used for a temporary period. The only other concern relates to the appearance of the existing wall, which is generally poor. It is considered that the wall should be lowered and treated in some form to improve the general appearance with the streetscene. Since the proposal is only for a temporary period the long term impact on the visual amenities of the locality will not be adversely affected.

### Recommendation

It is recommended that planning permission be granted subject to conditions.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Whilst the Manx Electricity Authority represents a statutory authority, the points raised in correspondence relate to Building Control matters and not planning and as such should not be afforded party status in this instance.

In summary, it is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded interested party status:

Highways Division of the Department of Transport
Accordingly the following parties are not afforded interested party status:
Manx Electricity Authority

C 1. This approval relates to use of the site as a car-park for a period of two years from the date of this notice; at the expiry of this period, the use as a car-park must cease unless there is by that date planning approval for a further period.

C 2. This permission relates to the creation of a temporary car park as shown in drawing numbers 243/3/1 and 243/3/2 date stamped 17th March 2008.

C 3. No development shall take place until details of the type of timber to be used for the fencing shall have been submitted to and approved in writing by the planning authority and thereafter the works shall be carried out in accordance with the approved details.

C 4. Prior to the first use of the car park, the existing wall on the north east boundary of the site shall be lowered to 1 metre in height and shall be painted white.

N 1. The applicant is advised that there are Underground Cables/Overhead Lines present in the area indicated in the planning application. Please contact Anthony Kinrade or Ian Horsey, Operations and Maintenance Department, Network Services, Manx Electricity Authority, (Tel. 687687) to discuss working practices around Cables and Overhead Lines which may need to be diverted before any work can be carried out on site.

The applicant is also advised to contact the Manx Electricity Authority for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 and GS6.
