### Officer's Report

#### The Site

The site represents the residential curtilage of an existing dwelling situated on the south eastern side of Oatfield Rise. The property is a semi-detached bungalow with low-pitched roof in a row of similar properties. The site backs onto Whitestone Garage.

#### Planning Status

The site lies within an area designated as Residential on the Isle of Man Planning Scheme (Development Plan) Order 1982.

#### Planning History

A single storey garage was permitted on the side of the property under PA 05/1899.

#### The Proposal

Now proposed is the erection of a timber garage/shed. This will be at the side of the property, replacing two existing sheds which sit at the back of the garden. The new garage will begin around three quarters of the way back along the side elevation, leaving plenty of space in front in which to park vehicles. The shed/garage will have a mono-pitched roof which is highest alongside the neighbour so the drainage is collected on the applicant’s side. The structure will be 2.5m high at the

apex, 7.6 m long along the boundary with 19, Oatfield Rise and finished in timber shiplap boarding. The side will project 1.1 m above the existing boundary wall but is 0.5 m higher than the fence or wall which could be erected without planning permission under the Town and Country Planning (Permitted Development) Order 2005.

## Representations

Malew Parish Commissioners indicate that they have no objections to the proposal. Department of Transport Drainage Division recommend a condition regarding surface water.

### Assessment

The shed could be used for vehicular parking and there is space for two vehicles in front of the garage on the existing driveway so there is no reason why the proposal should be rejected in terms of parking or road safety. The structure will be marginally higher than the fence or wall which could be erected under the Town and Country Planning (Permitted Development) Order 2005 so the structure is not considered unduly tall or imposing on the neighbouring property. There is no objection from the neighbour. As the structure will be finished in timber, its appearance is similar to that of a fence. A garage could be erected in the same place, less long but taller under the Town and Country Planning (Permitted Development) Order 2005.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
