### Officer's Report

The application site is currently a residential property within Douglas Town Centre. The site is zoned for mixed use purposes within the Douglas Local Plan. The proposed use would be compatible with the land use designation.

The only issue is whether the proposal will impact on the adjoining residential property in terms of noise disturbance. The application indicates the hours of operation will be 11am to 10.30pm six days

a week. I consider the hours of operation to be reasonable and would not cause any significant harm to the residents of the adjoining property.

I therefore recommend that planning permission be granted subject to conditions.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Whilst Isle of Man Fire and Rescue Service and the Isle of Man Water Authority represents a statutory authority, the points raised in correspondence relate to Building Control matters and not planning and as such should not be afforded party status in this instance.

The Disability Access Office has commented on the non-provision of disabled facilities in the proposal. These are non-planning matters and therefore should not be afforded interested party status.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the conversion of ground floor and first floor from residential to restaurant and wine bar (Use Class 3) as shown in drawing numbers 2320/1, 2320/2, 2320/3 and 2320/4 date stamped 14th December 2007; letter from Chrystals Estate Agent dated 3rd January 2008.

C 3. The use hereby permitted shall not be open to customers outside 0900-2230 hours on Monday to Saturdays. The use hereby permitted shall not be open on Sundays and Bank Holidays outside 1200-1900 hours.

N 1. The applicant is advised to contact the Fire Safety Department regarding all aspects of fire safety.

N 2. For a change in the water supply to premises (domestic or commercial) the applicant should contact the Isle of Man Water Authority Byelaws Inspector (Michael Karran), telephone 695957.

N 3. The Disability Access Office recommends that the gents toilet on the ground floor is altered to a disabled toilet with suitable amendments to the size and could be used on a uni-sex basis.

N 4. The applicant is advised that no approval is hereby granted or implied for the installation of an extraction system in connection with the restaurant use hereby approved. Such an extraction system must form the subject of a further planning application.
