## Item For Delegated Consideration TO: Jennifer Chance, Development Control Manager FROM: Anthony Holmes, Senior Planning Officer DATE: 3rd May 2012 Re: PA 07/02338/B – Erection of an extension to existing building to create six additional apartments and creation of additional car parking provision. Block 1, Oakhill Court, Douglas. The Development Control Manager is asked to consider a request to extend the date of expiry of the above approved planning application. The planning approval is currently due to expire on the 20th June 2012. Under article 13 of the Town and Country Planning (Development Procedure) Order 2005 the Department has power to extend the duration of a planning approval provided there are special circumstances to justify a longer period. The applicant’s agent has advised that they are currently preparing a building regulations application with a view to commencing works on site in the near future but do not have sufficient time to ensure that this is done before the 20th June 2012. No other reasoning for non-commencement is offered. In my view, no special circumstances to justify an extension have been put forward. Accordingly, I have to recommend that the request is dismissed. However, I do not knowingly believe that anyone would be disadvantaged if an extension of 12 months were to be granted and would not question my recommendation not being accepted. Consequently I feel a new application should be sought at the current proposal implemented.
