# Planning Refusal Notice

## Town and Country Planning Act 1999

## Town and Country (Development Procedure) Order 2005

Mr M L Corcoran
Riverside House
The Hope
St Johns
IM4 3AS

In pursuance of powers granted under the above Act and Order the PLANNING COMMITTEE of the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

**Name:** Mr M L Corcoran
**Proposal:** Vary condition one of PA 07/00197/B, and reposition containers to improve vehicular access
**at:** Heathfield Yard
Patrick Street
Peel
Isle of Man

which was considered on 15th February 2008, for the reasons set out below.

**Date of Issue:** 22nd February 2008

**Murray House**
**Mount Havelock**
**Douglas**

**Deputy Secretary to the Planning Committee**

## Reason(S) For Refusal:

1. The retention of the containers, which was the subject of two previous applications where both concluded that the containers must be removed from the site, would restrict the amount of space available for the parking and manoeuvring of vehicles associated with the legitimate use of the existing units on site. In addition, the containers would, if used, generate a need for parking and manoeuvring space. Finally, the position of the containers would restrict vehicular access to units 7, 8 and 9 within the yard.

**Note**
The containers on site must be removed within one month of the date that the decision becomes final.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.
