## THE APPLICATION SITE AND PROPOSED DEVELOPMENT

The application site comprises of an area of land that is located south east of Nobles Hospital in Braddan.

The proposed development comprises of the construction of a pavilion building to accommodate changing rooms and club room. The development is associated to the playing pitches that have approval on the adjoining land.

### Planning History

The application site has been the subject of one previous planning application that is considered specifically material to the assessment of this current planning application:

Planning application 06/01967/B sought approval for the laying out of sports pitches and associated car parking on the land directing adjoining the application site for this current planning application. The relationship of the two developments can be seen on drawing no. 1080-01B. This previous planning was considered and approved on the 10th May 2007, with the approval decision notice issued on the 15th May 2007.

## Representations

Braddan Parish Commissioners do not object to the planning application. The Department of Transport Highways Division do not oppose the planning application. The Department of Transport Drainage Division do not object to the planning application subject to conditions. The Police Architectural Liaison Officer expresses an interest in the planning application and highlights security issues. The Isle of Man Fire and Rescue Service recommend that the applicants consult them to discuss fire precaution measures. The Isle of Man Water Authority requests that an informative note be attached to any approval decision notice.

## Planning Policy

In terms of land use planning the application site is designated as land owned by Government in agricultural use under the Braddan Local Plan. There are no policies within the accompanying Planning Circular 6/91 that are considered specifically material to the assessment of this current planning application.

In terms of strategic plan policy, although the Isle of Man Strategic Plan contains policies identifying general planning considerations that are applicable to the assessment of a planning application it is considered that there are no specific policies within the plan that are material to the assessment of this current planning application.

## Assessment

The development proposed by the planning application is clearly linked to the development of playing pitches on the adjoining land. As such the need and justification for the proposed development is clearly understandable. The proposed development has been amended during the course of the planning application to take account of site specific comments from the Department of Transport Highways Division and the Police Architectural Liaison Officer. It has been concluded that these amendments address the issues raised by the various parties.

In terms of impact it is concluded that the substantial existing tree planting to the north/west of the application site combined with the overall scale of development suitably limits the visual impact of the proposal. Other possible public viewpoints of the application site are from significant distance. The proposed buildings are visually acceptable and considered appropriate for the application site.

The applicant's agent has identified that an oil tank will be needed on the application site but that one has not been shown on any of the submitted drawings. It was agreed that this was an uncontentious issue and that a condition relating to the submission of specific details prior to the commencement of development was acceptable.

Overall, the proposed development is considered acceptable and it is recommended that the planning application be approved.

It is considered that the following parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status:

**C 1.**
The development hereby permitted shall commence before the expiration of four years from the date of this notice.

**C 2.**
This approval relates to drawing no. 1080-00A date stamped the 20th November 2007 and drawing no.s 1080-01B, 1080-02G, 1080-03F and 1080-05 date stamped the 26th February 2008.

**C 3.**
Prior to the commencement of development details of the positioning and specification of any required oil tank must be submitted to and agreed by the Planning Authority.

**C 4.**
The proposed development must be connected to the main foul sewer.

**NOTE:** A Drainage Connection Fee will be payable to the Drainage Authority on this development

**C 5.**
There must be no discharge of surface water to the main foul sewer.

**N 1.**
The applicant/developer is recommended to contact the Isle of Man Fire and Rescue Service to discuss the provision of appropriate fire precaution measures.
