### Officer's Report

#### The Site

The site represents the curtilage of an existing shop unit which sits on the corner of North Quay and Quine’s Corner. The building is presently used as a newsagent’s.

#### Planning Status And Relevant Policies

The site lies within an area of Mixed Use specified as Town Centre on the Douglas Local Plan of 1998. This area includes all the properties on North Quay between Ridgeway Street and Bank Hill which include pubs, cafes, shops and take-aways.

## Planning History

Planning permission was granted under PA 06/1161 for a larger area in which this property sits, from retail to a fish and chip shop, restaurant and coffee house. Planning permission is being sought concurrently for the installation of signage (PA 07/1906).

## The Proposal

Proposed now is the change of use of the newsagent's to a coffee house. The indicative plans submitted would suggest that around 20 seats will be accommodated and the premises will be open between 7am and 6pm. The approval for the larger scheme was permitted subject, inter alia for operation between 9am and 10 o'clock at night Mondays to Saturdays and 12 noon and 7pm Sundays and Bank Holidays.

## Representations

The Isle of Man Water Authority recommend the attachment of a note regarding the provision of water supplies to the site. The Isle of Man Fire and Rescue Service recommends consultation regarding fire precautions. Douglas Corporation indicates that it has no objection to the application.

The occupant of 7, Quine's Corner objects to the application on the basis that there is already permission for the conversion of 3, Quine' Corner to a similar use and they already suffer fumes and smell nuisance from the chip shop on the corner.

## Assessment

The site lies within an area characterised by eating and drinking establishments and the proposed use will complement this.

Whilst there is an objection from the occupant of 7, Quine's Corner this is on the basis of potential smell nuisance, the application is for use as a coffee shop which is not likely to generate the same sort of smell nuisance as the fish and chip shop and the facility is not open after tea time or in unsociable hours. It was a condition of the approval for the larger scheme in 2006 that a scheme for the extraction of cooking smells, etc be installed. If this is not working, perhaps this is more a matter for Environmental Health. The matter of conflict between the commercial and residential premises was considered in the earlier application and the Inspector concluded that a properly installed ventilation system should provide for the protection of residential amenity and the same would apply in this case if such a system were required which it may not be if cooking is not undertaken on the premises.

## Party Status

The Isle of Man Fire and Rescue Service and The Isle of Man Fire and Rescue Service raise issues which are the responsibility of other legislation and procedures and as such should not be afforded party status in this instance.

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The occupant of 7, Quine's Corner is sufficiently close to the application site to warrant party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the conversion of the premises to a coffee shop as shown and described in drawings received on 12th October, 2007.

C 3. The premises may only be open between the hours of 7am and 6pm and between 12 noon and 6pm on Sundays and Bank Holidays.

C 4. No approval is hereby permitted for the installation of any ventilation or extraction system as none has been shown in the application drawings. If such a system is required as a result of cooking operations within the premises, such must be the subject of a planning application following consultation with the Environmental Health Inspectorate.

N 1. For a change in the water supply to premises (domestic or commercial) the applicant should contact the Isle of Man Water Authority Byelaws Inspector (Michael Karran), telephone 695957.

N 2. PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken.
