### The Site

The site represents the residential curtilage of an existing, newly built property within the residential development to the west of Shore Road in Kirk Michael.

### Planning Status And Relevant Policies

The site lies within an area designated as Predominantly Residential on the Kirk Michael Local Plan of 1994.

### Planning History

The development in which the application property sits was permitted under PA 02/1754 and amended under 04/1331.

### The Proposal

Proposed is the erection of a summer house in the garden. This will be 2.93m high and 2.96m by 4.34m in area.

## Representations

Michael Parish Commissioners raise no objection to the application and The Isle of Man Fire and Rescue Service recommends the installation of domestic smoke detection.

## Assessment

The summer house is relatively modest and only slightly higher than would be permitted under the Town and Country Planning (Permitted Development) Order 2005. The summer house will be erected in the rear of the back garden of the property, not overly close to neighbouring property and unlikely to result in any adverse impact on the property behind.

## Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The points raised by the Isle of Man Fire and Rescue Service are the responsibility of the Building Regulations and as such this party should not be afforded party status in this instance.
