### Officer's Report

The application site is currently sub-divided into 4 flat. However, there does not appear to be a planning permission for its sub-division. I will therefore assess the application as it has never been sub-divided.

The proposal is to create 3 apartments within the building. The layout of building appears to be acceptable and provide a satisfactory outlook from each of the apartments. All the apartments can be access the rear yard, which will have the refuse bins.

The application does not oppose any off road parking. The Highways Division of the Department of Transport have not objected to the application, as the proposal is located within Douglas town centre within close proximity to public car parking and public transport facilities.

I therefore recommend that planning permission be granted subject to conditions.

## **PARTY STATUS**

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

Whilst IoM Fire and Rescue Service and the Isle of Man Water Authority represents a statutory authority, the points raised in correspondence relate to Building Control matters and not planning and as such should not be afforded party status in this instance.

The Environmental Health Officer represents part of the Department of Local Government and the Environment and as such forms part of the Planning Officer's case. As such separate party status should not be afforded in this instance. In any case the points raised by the Environmental Health Officer relate to separate legislation and are not material planning considerations.

## **C 1.**

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

## **C 2.**

This permission relates to the conversion of the building to provide three residential apartments as shown in drawing numbers 1970/1, 1.7129-001-00 and 1.7129-101-00 date stamped 23th October 2007.

## **N 1.**

The proposed flats must, on completion of the proposed works, comply with the requirements of the Housing (Flats) Regulations 1982 and be registered thereafter under the same Regulations.

## **N 2.**

The applicant is advised to contact the Isle of Man Water Authority regarding the water supply to the apartments.

N 3. The applicant is advised to consult the Fire Safety Department as the proposal may fall within the scope of the Fire Precautions (Flats) Regulations 1996.
