### Officer's Report

#### The Site

The application site represents the curtilage of 19 Market Street Peel, an end terrace traditional property the front of which is partly obscured by the adjacent chapel and the land to the side of the property is not readily viewed from Market Street. To the rear, the site extends towards the car park accessed from Peel Promenade. Views of the site may be gained from the vehicular access from Castle Street.

#### Planning Status

The application site is located within an area identified as being “Mixed Use” by the adopted Local Plan, this being the Peel Local Plan (Planning Circular 6/89). The site is also situated within the Peel Conservation Area and as such any proposed development must be assessed in terms of whether it will preserve or enhance the special character of the conservation area. Within the adopted Isle of Man Strategic Plan, the following policies are considered to be relevant to the assessment and determination of this application:

Environmental Policy 34, which states:

"In the maintenance, alteration or extension of pre-1920 buildings, the use of traditional materials will be preferred."

Environmental Policy 35, which states:

"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

Paragraph 8.12.1 which states:

"As a general policy, in built up areas not controlled by Conservation Area or Registered Building policies, there will be a general presumption in favour of extensions to existing property where such extensions would not have an adverse impact on either adjacent property or the surrounding area in general."

Whilst this general presumption in favour of extensions to existing properties does not apply directly to this application site, it being located within a Conservation Area, the general considerations relating to extensions are considered to be valid criteria in the assessment of this application.

## PLANNING HISTORY

The following previous planning applications are considered relevant in the assessment and determination of this application:

Planning application 06/01768/B sought approval for alterations, the erection of a two storey extension on the side elevation and the erection of a single storey extension to the rear of the property. This was refused 24th January 2007 with the reason for refusal stating, "The proposed alterations and extensions to the dwelling, which is located within the Peel Conservation Area, would, by their design, fenestration and loss of traditional features, neither preserve nor enhance the character of the area."

Planning application 95/00193/B sought permission for alterations and an extension to the property. This was approved 12th June 1995.

REPRESENTATIONS

The Department of Transport Highways Division does not oppose this planning application. Peel Town Commissioners recommend that this application is approved. The Isle of Man Fire and Rescue Service request that a note relating to the installation of smoke detectors be attached to any subsequent approval.

We have received no privately written representations in relation to this planning application.

## THE PROPOSAL

This application seeks approval for alterations and the erection of a two storey and a single storey extension and is a resubmission of the refused planning application 06/01768/B. The application differs from the previously refused scheme primarily in the proposed fenestrations which are now shown to be of a more regular layout using vertically proportioned windows of simple rectangular form. The north elevation would feature glazed hardwood doors and side windows to both the ground and first floor. To the rear of the property, the previously proposed first floor double doors and ground floor door have been replaced with a single area of glazing which would act to mark the transition between the existing building and the proposed extension. A single storey extension would project from the rear elevation and would feature a central glazed lantern light. Materials proposed are to match the existing dwelling with painted render walls and hardwood windows featuring central horizontal glazing bars.

## Assessment

It is considered that this proposal now accords with the provisions of the relevant planning policies in that the design of the proposed extensions would preserve the character of the Peel Conservation Area and would be in-keeping with the existing dwelling. Where the design adopts a more modern approach, such as with the glazed gable elevation, this has been done so in a sympathetic way which would not detract from the area.

The extensions as proposed would not have an adverse impact on any adjacent properties and the view of the site from Castle Street would be of a traditionally styled elevation utilising traditional materials characteristic of the Conservation Area. The site is of a sufficient size to comfortably accommodate the proposed extensions and it is considered that this development would preserve the character and appearance of the Peel Conservation Area.

### Recommendation

It is recommended that the application be approved.

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:
