In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

which was considered on 26th November 2007, for the reasons set out below.

## Reason(S) For Refusal:

1. The proposed dwellinghouse would be contrary to General Policy 2, Housing Policy 6 and Environment Policy 42 of the Isle of Man Strategic Plan 2007 by reason of its height, design, siting and massing would:

i) result in the introduction of a prominent and incongruous dwellinghouse which is out of keeping with the general character and appearance of the locality and would therefore cause significant harm to the visual amenities of the street scene;

ii) result in demonstrable harm to the occupiers of No.6 Sydney Street from overlooking, loss of privacy, visual intrusion and overbearingness; and

iii) result in demonstrable harm to the occupiers of No.5 Sydney Street from overbearingness and visual intrusion.

2. The proposed car parking provision for the new dwellinghouse would be contrary to Transport Policy 7 of the Isle of Man Strategic Plan 2006 in that an inadequate number of parking spaces would be provided within the development. This would result in on-street parking within Sydney Street/Oxford Street where the demand for parking is already high.

3. The proposed development would not provide a satisfactory living environment for the future occupiers of the dwellinghouse due to the inadequate provision of private amenity space.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.
