#### The Site

The site represents the curtilage of the two storey mid-terrace dwelling 30 Slieau Whallian Park, St Johns. The property is situated approximately midway along a terrace of 10 similar properties which face north and are set out so that every two subsequent dwellings step forward from the last two properties. Some of the dwellings have attached single storey garages which project from the rear elevation. The orientation and siting of the buildings means that vehicular access is gained from the rear with the front being served by a footpath only.

#### Planning Status

The site is located within an area identified as being Predominantly Residential Use by the St Johns Local Plan. The site is not within a conservation area. Paragraph 8.12.1 of the Isle of Man Strategic Plan states:

'As a general policy, in built up areas not controlled by Conservation Area or Registered Building policies, there will be a general presumption in favour of extensions to existing property where such extensions would not have an adverse impact on either adjacent property or the surrounding area in general.'

### Planning History

Planning application 05/00179/B sought permission for the erection of a second storey over the existing garage and a rear porch and lift to provide additional disabled access and living accommodation. This was refused with the reason for refusal being that the proposed extension would have an unacceptable impact upon the neighbouring property, 31 Slieau Whallian Park. A note was attached to this refusal recommending that the applicant considers alternative means of providing the required accommodation without adversely affecting the neighbouring property.

### Representations

German Parish Commissioners have not commented on this application. The Department of Transport Highways Division does not oppose this application. The Department of Transport Drainage Division does not object subject to a condition relating to surface water being attached to any subsequent approval.

We have received no privately written representations in relation to this planning application.

### The Proposal

This proposal seeks permission to construct a two storey projecting gable extension to the rear of the property to provide additional living accommodation. This would be built along side the existing garage and as a result of the stepping forward of the property from the neighbouring dwelling 29 Slieau Whallian Park, there would be no impact upon that property. The materials proposed are to match the existing building.

### Assessment

The rear elevations of the terrace display a variety of projecting extensions including both single storey and two storey which would appear to be original to the design of the estate. This proposal would be in keeping with these in terms of form and would not detract from the street scene.

The extension would not impact upon 31 Slieu Whallian Park as a result of its positioning. Given that this application resolves the issues of the previously refused application, it is considered that it would comply with the general policy as set out within Paragraph 8.12.1 of the Isle of Man Strategic Plan. It is recommended that this application is permitted.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the plans and drawings PT 01, PT 02, PT 03, PT 04 and PT 05 submitted and date stamped 21st September 2007.

C 3. The external finishes of the extension must match those of the existing building in all respects.

C 4. There must be no discharge of surface water (directly or indirectly) from this proposed development to any foul drainage system(s) so as to comply with the requirements of the Department of Transport Drainage Division and the Sewerage Act 1999.

N 1. The application states that the surface water from the proposed development is to be discharged to the "existing drainage". If this "existing drainage" discharges (directly or indirectly) to the foul sewerage system then it should be noted that an alternative means of surface water disposal must be provided.
